The Wharton County Grand Jury met on Tuesday, Nov. 3 and handed down an indictment to Brandon Shimek for murder.
According to the El Campo Police Department, dispatch received an ambulance call to 1208 Alvin Street at 2:24 p.m. on Sept. 7. Patrol officers were also dispatched to the scene.
Upon arrival, officers found Justin Wayne Lipinski, 32, lying in the driveway, deceased from an apparent gunshot wound.
Patrol officers secured the scene and the Criminal Investigations Division (CID) was called out. The investigation, according to ECPD, went through the afternoon, into the late night and early morning.
At 2:25 a.m. on Sept. 8, Shimek, 26, was arrested on a warrant for the alleged murder of Lipinski.
ECPD was assisted in the investigation by the Texas Rangers and the Wharton County Sheriff’s Office.

Christopher Hughes for possession of a controlled substance PG 1 (4-200 grams) and possession of a controlled substance PG 2 (4-400 grams);
Ashley Haynes for possession of a controlled substance PG 1 (4-200 grams) and possession of a controlled substance PG 2 (4-400 grams);
Ryan Whittington for possession of a controlled substance PG 1 (1-4 grams);
Steven Sanchez for possession of a controlled substance PG 1 (less than 1 gram);
Michael Washburn for failure to register as a sex offender;
Ramon Flores for sexual assault and possession of a controlled substance PG 1 (less than 1 gram);
Nasquier Perez-Cardona for two counts of credit card abuse;
Jared Mahalitc for theft ($2,500-$30,000);
Justin Crump for assault, family violence, with a deadly weapon;
Arthur Saucedo Jr. for theft and aggravated robbery;
Joshua Cole-Kelly for failure to register as a sex offender;
Gloria Munoz for possession of a controlled substance PG 1 (less than 1 gram) and unauthorized use of a motor vehicle;
Frank Mendiola for unlawful possession of a firearm by a felon;
Jacob Montalvo for evading arrest with a vehicle;
Pete Rodriguez for possession of a controlled substance PG 1 (less than 1 gram);
Leo Hudlin III for manufacturing or delivery of a controlled substance PG 1 (4-200 grams), possession of a controlled substance PG 1 (less than 1 gram) and possession of a prohibited substance in a correctional facility;
Faith Scott for possession of a controlled substance PG 1 (less than 1 gram) and tampering;
Michael Newton for possession of a controlled substance PG 2 (less than 1 gram);
Garrett Hunter for possession of a controlled substance PG 1 (less than 1 gram);

All individuals are presumed innocent until proven guilty in a court of law.
